Terms of service

These terms govern your use of Freshness Validator (the "Service"), operated by International and Pacific Enterprises, LLC, a Hawaii limited liability company ("we", "us"). By creating an account or calling the API, you agree to them.

The Service

The Service scores how fresh context supplied by your software agents is, and monitors source URLs you register. Scores are automated estimates. They are not guarantees that any content is accurate, current, or complete, and you remain responsible for decisions your agents make.

Accounts and keys

We issue API keys to agents you set up with us. Keep keys secret. You are responsible for activity under your keys. Tell us promptly if a key is exposed so we can revoke it.

Acceptable use

You may register only URLs you are allowed to have us fetch. Do not use the Service to attack, overload, or scrape sites in violation of their terms, to access private or authenticated content, or to break the law. We may rate-limit, suspend, or end access that harms the Service or others.

Credits and payment

The Service is prepaid. Calls deduct credits at the rate for your tier, as shown on the pricing page. Prices and tiers may change with notice. See the refund policy for unused credits.

Availability

The Service is early-stage and provided as is, without warranties of any kind. We do not promise uninterrupted availability. Any service commitments for a specific customer must be agreed in writing.

Liability

To the extent the law allows, we are not liable for indirect or consequential losses, and our total liability for any claim is limited to the amount you paid us in the three months before the claim arose.

Governing law and disputes

These terms, and any dispute arising out of or relating to them or the Service, are governed by the laws of the State of Hawaii, without regard to its conflict-of-law rules. Any such dispute will be brought exclusively in the state or federal courts located in the State of Hawaii, and you and we consent to the jurisdiction of those courts.
